LEGAL ACCEPTANCE

PROOFIP provides the Service according to the European Union Regulation (EU) No 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93/EC (eIDAS Regulation).

In accordance with the eIDAS Regulation, PROOFIP is a Trust Service Provider of the electronic timestamps with the issuance of the relevant Certificates.

Following to the Article 41 (Legal effect of electronic time stamps) of the eIDAS Regulation:

«1. An electronic time stamp shall not be denied legal effect and admissibility as evidence in legal proceedings solely on the grounds that it is in an electronic form or that it does not meet the requirements of the qualified electronic time stamp[…]».

Electronic timestamp has legal effect and admissibility as evidence in legal proceedings and shall be recognised as such in all EU member states.

The eIDAS Regulation stipulates that there shall be no restriction on the provision of trust services in the territory of a Member State by a trust service provider established in another Member State.

While objects of Copyright do not need any formal state registration for their recognition or legal protection (due to the Berne Convention for the Protection of Literary and Artistic Works of September 9, 1886 / 179 countries are parties), for the legal recognition of inventions, industrial designs, trademarks an official registration by a state body is mandatory required.

In such case, PROOFIP makes fixation of ownership on the intellectual asset at any intermediate stage prior to the formal registration of the completed result (inventions, industrial designs, trademarks) by a state authority.
